日本の特許庁は、原出願の拒絶査定後、拒絶査定不服審判請求にあわせて出願された分割特許出願について、その分割出願の審査を原出願の審判結果が判明するまで中止することができる運用を、2023年4月1日から開始することを発表しました。   この新しい運用により、原出願の結果を考慮して分割出願に対応することが可能になり、出願人にとって効率的かつ効果的な出願戦略を構築することができると期待されています。対象となる出願は、原出願の拒絶査定後に分割され、2023年4月1日以降に審査請求がされた出願で、原出願が前置審査又は拒絶査定不服審判に係属中の場合に適用されます。出願人は、本運用の適用を申請するために上申書等を提出する必要があります。     

The Japan Patent Office (JPO) has announced that from April 1, 2023, it will operate a system under which the examination of a divisional patent application filed in connection with a request for an appeal against an examiner's decision of refusal following the decision of refusal of the original application may be suspended until the outcome of the appeal of the original application is known.   It is expected that this new operation will make it possible to respond to divisional applications by taking into account the outcome of the original application, thereby creating an efficient and effective filing strategy for applicants. The application subject to this operation is an application that has been divided after the decision of refusal of the original application and for which a request for examination has been filed on or after April 1, 2023, and for which the original application is pending a preliminary examination or an appeal against the decision of refusal. The applicant is required to file a written request, etc., to request the application of this operation.
